Domestic Assault & Assault Peace Officer: Absolute Discharge – R. v. T.A (Surrey)

Charge: Assault (Domestic); Assault of a Peace Officer

Issue: Whether the Crown could prove the charges based on the available evidence; Whether it was appropriate to not punish our client for the offence.

Result: After identifying shortcomings in the Crown’s case and advising our client through a rehabilitation program, Mr. Mines persuaded the Crown to drop the domestic assault charge in exchange for a peace bond. Further, Mr. Mines persuaded the judge to order an absolute discharge for an assault on a police officer. No court ordered punishment. No criminal record.
