R. vs. M.S. – Burnaby RCMP Investigation

Charges: Assault, mischief under $5000.

Issue: Whether it was in the public interest to proceed with the criminal prosecution.

Result: Mr. Mines was able to persuade the investigating  RCMP officer to allow our client tp apologize to the complainant through Restorative Justice. Police did not seek to have any criminal charges approved. No criminal record.

R. vs. W.W. – North Vancouver Provincial Court

Charge: Assault.

Issue: Given the information Mr. Gauthier was able to provide to the RCMP investigator, whether it was in the public interest to proceed with a criminal prosecution.

Result: Based on the information Mr. Gauthier provided, the investigating officer directed that our client be referred to Restorative Justice, rather than to Court. No charge was approved. No criminal record.

 

R. vs. K.C. – Richmond Provincial Court

Charges: Fraud Under $5000; Possession of Stolen Property (from Employer).

Issue: Given our client’s circumstances and the circumstances of the offence, whether it was in the public interest to proceed with a criminal prosecution.

Result: Mr. Johnson was able to persuade Crown counsel to refer our client to Restorative Justice and the Alternative Measures Program and to stay the criminal charges upon completion. No criminal record.

R. vs. Z.H. – Port Coquitlam Youth Court

Charge: Assault Causing Bodily Harm.

Issue: Whether, given the history between our client and the complainant, it was reasonable for our client apply  the level of force he used.

Result: Mr. Johnson was able to persuade Crown to not approve any criminal charge but, rather, to resolve the matter through Restorative Justice. No criminal record.
